Point of view is a powerfully compelling force. Daniel McCarthy is a case in point. In his lawfare column of April 3, he wrote that Republicans must insure themselves against it. His point of view, apparently, is that any legal action against Donald Trump lacks legitimacy. That laws were broken is irrelevant; that lawyers misrepresented facts in election cases and were criticized or punished for so doing is beside the point.
My favorite part of the column was his view of the extortion against law firms. He wrote that exclusion from federal buildings serves to limit their lobbying activity, which they do for Republican causes more than Democratic ones (see https://www.opensecrets.org/industries/lobbying?cycle=2022&ind=K01), but the real hammer is that federal courtrooms are in federal buildings. A D.C. law firm excluded from federal courts is out of business. This gangster act may not even be legal, but, of course, challenging the order would be “lawfare.”
Mr. McCarthy describes the rights being stripped as “privileges.” This is a vivid point of view choice of words. It goes with calling our social safety net “entitlements.”
