The DUI case against Robert Earl Smith Jr. has been dismissed.
Smith, 36, was arrested in August by officers with the Columbus Police Department after he was observed driving recklessly in front of Club Heidiho in east Columbus.
Smith refused to take a breathalyzer test and was charged with DUI refusal as well as careless driving.
Municipal Judge Bennie Jones on Tuesday dismissed the DUI charge but found Smith guilty of reckless driving. He was fined $203 for the misdemeanor charge.
