Mississippi lawmakers can support President Trump’s work to ensure fair access to banking for all Americans this session. I hope they take advantage of this opportunity by looking to the President to end government-driven debanking, rather than trying to add unnecessary regulations at the state level.
Debanking is when a bank account is closed, restricted or denied. While banks can rightfully make this decision due to regulatory compliance or risk factors, government regulators under the Obama and Biden administrations pressured banks to close accounts for political or social reasons, restricting private businesses and disfavored industries.
President Trump rightfully issued an executive order calling on regulators to remove “reputation risk” from their criteria and asking Congress and the Treasury to create a lasting federal solution.
MS HB 1597 is well-intentioned and aims to protect Mississippi residents. However, it attempts to fix a problem that President Trump and federal lawmakers are already addressing. Creating a Mississippi-only complaint process and enforcement framework adds regulatory burden to banks, requiring additional resources to comply. A patchwork of conflicting state laws ultimately harms consumers and could increase compliance costs, potentially proving untenable and especially so for our small banks.
I thank Mississippi lawmakers for their attention to this issue. However, I urge them to support a uniform national fair access standard that removes politics from banking decisions and restores accountability at the federal level.
