JACKSON — A federal appeals court has scheduled oral arguments in a child pornography case from Mississippi.
The 5th U.S. Circuit Court of Appeals has set arguments for April 2 in Houston, Texas.
Robert Warren Triplett Jr. was sentenced in 2011 to 10 years in federal prison for possession of child pornography.
Triplett pleaded guilty in 2010 to one count of possession of child pornography.
Triplett was arrested in October 2009 after investigators found explicit photos of minor children on a computer obtained from his home. The computer was examined during an investigation into the September 2009 disappearance of Triplett’s 21-year-old stepdaughter.
In his appeal, Triplett attacks the search warrants used by authorities to gain access to his computers and other evidence. A federal judge in Mississippi upheld the validity of the search warrants.
Triplett argued the search warrants did not spell out what authorities hoped to find. He said anything seized could not therefore be used against him.
Federal prosecutors said in court documents that Triplett’s wife also allowed agents to search the home which also made valid the seizure of the computers where the child pornography was found.
