An August grand jury did not indict the son of a state senator on felony possession of a controlled substance charge, but that does not mean the case is over.
Capt. Archie Williams, the head of the narcotics unit with the Lowndes County Sheriff’s Office, told The Dispatch on Friday that the case against Colton Younger, the 22-year-old son of state Sen. Chuck Younger, will be presented to a grand jury with new evidence during the next term. Williams said that state Crime Lab results from pills collected from Younger had not been completed by the time the case was presented to the last grand jury.
“At the time of the last grand jury, we had yet to receive the full crime report,” Williams said.
Assistant District Attorney Lindsay Clemons told The Dispatch drug cases are often “no-billed” the first time they are presented to a grand jury while awaiting results from the Crime Lab. New evidence means cases are represented, not that a grand jury will necessarily indict.
Columbus Police Department Capt. Brent Swan said that on May 6, officers found Colton Younger in possession of two prescription pills. At the time, Younger was a passenger in a vehicle stopped on Military Road. CPD worked with the LCSO to investigate.
Williams said computer software that identifies pills indicated the pills to be OxyContin, possession of which by a non-prescription authorized person is a felony. An arrest warrant was issued.
Younger was arrested on May 14 by LCSO deputies while driving near his home. He was also charged with misdemeanor driving with a suspended license.
